BILL NUMBER:S5891

Title of bill

An act to amend the tax law, in relation to exemptions to the petroleum business tax

Purpose

This legislation would exclude diesel and motor fuel used in cranes that are used off-road from the Petroleum Business Tax.

Summary of provisions

Amends subdivision (a) of section 301-b of the Tax Law by adding a new paragraph (9) to include diesel and motor fuel used in cranes.

Justification

Currently, all diesel and motor fuel used in cranes is subject to the Petroleum Business Tax. However, many cranes are used for off-road use and they are never used on any roadway. Given that many owners of these cranes use them for their daily operations, the operating costs for the fuel can become quite costly. This bill seeks to exempt diesel and motor fuel that is used in cranes for off-road operation from being subject to the Petroleum Business Tax.
