BILL NUMBER:S5918
Title of bill
An act to amend the penal law, in relation to the validity of a license to carry and possess a firearm in the city of New York
Purpose
The purpose of this bill is to grant validity to licenses to carry a pistol or revolver held by dealers, manufacturers, and gunsmiths while travelling through the city of New York during their course of employment.
Summary of provisions
Section 1: Subdivision 6 of section 400 of the penal law is amended by adding the following "; or provided that (f) the licensee is a dealer, manufacture/ or gunsmith of firearms and is carrying or possessing the firearms in the course of their employment".
Justification
Dealers, manufacturers, and gunsmiths are often tasked with transporting high value, military grade firearms and equipment during their course of employment. Many posses a license to carry a concealed firearm during the course of business to provide protection in the event of a robbery. However, licenses to carry a firearm held by dealers, manufacturers, and gunsmiths are not valid while traveling through New York City. As a result, before reaching the city, they must stop and store their pistol or revolver in a locked container, leaving them unprotected in the event of a robbery.
Seeing that dealers, manufacturers, and gunsmiths may be carrying tens of thousands of dollars' worth of firearms, they should be afforded the same protections as those carrying large sums of money. Furthermore, should a dealer, manufacturer, or gunsmith be the victim of a robbery during their course of their business, a large quantity of military grade firearms and high capacity magazines could end up on the black market.
