BILL NUMBER:S5933
Title of bill
An act to amend the public health law and part A of chapter 56 of the laws of 2013 relating to establishing the home and community-based care work group, in relation to regulatory alignment of home care services delivered under contract with managed care plans
Purpose
to require the Commissioner of Health to consider the recommendations of a work group that has met for over a year and to potentially waive duplicative rules and regulations as recommended by the work group.
Summary of provisions
Would amend unconsolidated law enacted as part of the 2013-14 state budget that established a home and community-based work group to examine federal and state regulatory requirements and make recommendations in light of the expansion of most Medicaid services for long-term care populations into managed care. The amendment would require the commissioner to consider and implement the recommendations of the work group.
The bill would amend Article 36 of the Public Health law and makes a conforming amendment to Article 44 of the Public Health Law to enable the commissioner to waive duplicative and conflicting requirements between home care providers and the managed care plans in order to promote efficiency, coordination and clarity in the provision of care.
Justification
Enacted as part of the state budget for 2013-14, the home and community-based work group has met consistently and produced an authoritative set of recommendations to the Department of Health. While the Commissioner cannot waive federally mandated obligations on providers, this bill would permit the Commissioner to waive state rules and regulations that conflict or duplicate federal obligations.
