BILL NUMBER:S5939 REVISED MEMO 06/12/2015
Title of bill
An act to amend the public health law, in relation to continuing medical education on pain management, palliative care and addiction
Purpose
To make technical amendments to S 4348 of 2015 including clarification that health care professionals authorized to prescribe controlled substances who are required to complete medical education on pain management, palliative care, and addiction do so prior to renewal of their license rather than every two years..
Summary of provisions
Section one makes technical amendments to § 3309-a of the PHL to clarify that rather than CME being required every two years it is required prior to renewal of registration to practice, which is not two years for all prescribers It also clarifies that the CME shall be deemed to count toward existing CME requirements for licensure not just toward a professional's obligation for board certification which not all prescribers have.
Section two provides an effective date
Justification
Senate bill 4348 of 2015 requires health care professionals who prescribe controlled substances to take a continuing medical education (CME) course regarding pain management and addiction to assist in curbing the opioid abuse crisis and provide the best care possible. This bill makes two technical corrections to address concerns raised by the dental community.. It clarifies 1) that the CME must be completed prior to licensure renewal rather than every two years and 2) that such CME shall be deemed to count toward existing continuing education requirement for licensure as well as professional board certification as specified in S 4348.. These changes ensure that the CME provisions are consistent with all licensed professionals required to complete coursework, particularly dentists who do not have board certifications and renew their licensure every 3 not 2 years.
