BILL NUMBER:S5948

Title of bill

An act to amend the environmental conservation law, in relation to the powers and duties of the Historic Hudson-Hoosic Rivers Partnership

Purpose

Expands the powers and duties of the Historic Hudson-Hoosic Rivers Partnership to include the power to appoint and remove officers, agents and employees and determine their qualifications, duties and compensation; to adopt and use a seal; to retain or employ counsel, private consultants and independent contractors; to construct or cause to have constructed necessary facilities, including paths and trails, a visitor education center, and related parking areas within the reserve; and to acquire specified property within the reserve.

Summary of provisions

Section 1 amends subdivisions 4 and 5 of section 42-0107 of the environmental conservation law by granting the authority to remove an executive officer, officers, and agents as well as the ability to employ counsel, private consultants and independent contractors.

Section 2 amends section 42-107 of the environmental conservation law by renumbering subdivision 13 as subdivision 15, and adding two new subdivisions 13 and 14. The additions grant the authority to adopt and use a seal and to construct or cause to have constructed the necessary facilities described in section 3.

Section 3 describes the property where the Visitor's Center will be located as well as the Sword Surrender Site, the location where British General John Burgoyne surrendered to American General Horatio Gates on October 17, 1777.

Section 4 is the effective date.

Justification

The Historic Hudson-Hoosic Rivers Partnership is a public benefit corporation created by an act of the legislature in 2006. Its mission is to preserve, protect, and promote the natural, farmland, and heritage resources of the northern Hudson River and Hoosic River watersheds. The Partnership consists of over 20 local municipalities, state agencies, not-for-profit organizations, and the National Park Service. The Partnership is currently working with the federal government to construct a regional gateway visitor center and has already helped preserve hundreds of acres of important farmland and open space. Allowing these new powers and duties will ensure that it can continue to fulfill its public mission
