Title of bill

An act to amend the public housing law, in relation to income from employment of children

Purpose of bill

Relates to excluding income from the employment of children when calculating income for the selection of tenants.

Summary of provisions

Section One - Amends paragraph a of subdivision 1 of section 156 of the public housing law, by chapter 21 of the laws of 1982 to include income from employment of children, including foster children, under the age of eighteen years and income from each full-time student eighteen years of age or older, excluding the head of household and spouse, earning in excess of four hundred eighty dollars per month shall be excluded in calculating household income.

Section Two - This act will take effect immediately.

Justification

Currently in New York State the selection of tenants for low income housing requires a "minors income above $2,000 (or lower limit that an authority may establish) is to be included in the determining the family's aggregate annual income solely for the purpose of establishing the rent that is to be paid, in accordance with the authority's rent schedule. This income shall not be included in determining eligibility for admission or continued occupancy of applicants or tenants, as the case may be."

In some instances by some authority's in the State, part time jobs or summer jobs that are held by minors, under the age of 18, is calculated and budgeted as if this income is received on a monthly basis all year long. This current practice not only deters students from working but familiar to report all student income cad result in termination or even criminal charges for fraud.
