Title of bill

An act to amend the public health law, in relation to smoking restrictions

Purpose or general idea of bill

Prohibit smoking within fifteen feet of a designated school bus stop during certain times.

Summary of specific provisions

Section 1. Subdivision 2 of Section 1399-0 of the public health law is amended by adding a new paragraph c which would prohibit smoking within fifteen feet of any designated school bus stop during the hours that student may be boarding or alighting from a school bus.

Section 2 includes the effective date.

Justification

According to the Centers for Disease Control and Prevention, second hand smoke contains over 7,000 chemicals, including hundreds that are toxic and about 70 that can cause cancer. For our children, this smoke can cause ear infections, severe asthma attacks, respiratory symptoms such as coughing, sneezing and shortness of breathe, infections such as bronchitis and pneumonia and a greater risk of SIDS.

As our children prepare or end for their day at school, they should not be forced to breathe dangerous second hand smoke. This legislation would ensure all children are protected from second hand smoke when entering or exiting a school bus.
