Title of bill

An act to amend the correction law, in relation to authorizing the Washington county correctional facility to also be used for the detention of persons under arrest being held for arraignment in any court located in the county of Washington and authorizing the Essex county correctional facility to also be used for the detention of persons under arrest being held for arraignment in any court located in the county of Essex

Purpose

Authorizes the Washington and Essex county correctional facilities to also be used for the detention of persons under arrest being held for arraignment in any court located in each county.

Summary of provisions

Section 1 - Amends Section 500-a of the Correction Law by adding subdivision 2-o that allows the Washington County jail to detain persons under arrest being held for arraignment in any court in Washington County; also adds subdivision 2-p allowing the Essex county correctional facility to also be used for the detention of persons under arrest being help for arraignment in any court located in the county of Essex.

Section 2 - Amends Section 500-c of the Correction Law by adding a subdivision 21 to provide that in Washington county all provisions of the section shall apply equally in any case where the sheriff is holding a person under arrest for arraignment prior to commitment as if such person had been judicially committed to the custody of the sheriff and such person may be held in the Washington county correctional facility; also adds subdivision 22 to provide that in Essex county all provisions of the section shall apply equally in any case where the sheriff is holding a person under arrest for arraignment prior to commitment as if such person had been judicially committed to the custody of the sheriff and such person may be held in the Essex county correctional facility.

Section 3 is the effective date.

Justification

Washington County is a rural county whose population is dispersed over a large geographic area served by twenty-five (25) local courts and nine (9) law enforcement agencies. The Washington County Sheriff is requesting legislation, which would permit the use of the Washington County jail by various police agencies as a holding cell for pre-arraigned prisoners, allowing for the best utilization of county resources and staff allocations. This legislation will assist the County of Washington in its continuing efforts to insure that counsel for all parties are present at all crucial proceedings including the arraignment and other initial appearances.
