Sponsor's memo

Title of bill

An act to amend the public service law, in relation to siting of major electric generating facilities

Purpose or general idea of bill

This legislation would require power plants sited under article X to prepare an environmental impact statement in accordance with the State Environmental Quality Review (SEQR).

Summary of specific provisions

Section 1 would require power plants sited under article X to prepare an environmental impact statement in accordance with the State Environmental Quality Review (SEQR).

Section 2 is the effective date.

Justification

Under Article X power plants that are sited have a litany of safeguards in place that they must adhere too. However they currently do not have to comply with the State Environmental Quality Review (SEQR). SEQR exists to help ensure that appropriate major projects have a thorough vetting of environmental law and impacts. While power plants currently have steps to take to consider these impacts, it is only appropriate to extend SEQR to these proceedings as well.
