Title of bill
An act to amend the correction law, in relation to requiring level one sex offenders to register for 30 years
Purpose
This bill would require level one sex offenders to register with the Division of Criminal Justice Services for thirty years.
Summary of provisions
Section one amends subdivision eleven of section 168-b of the correction law, relating to the duties of the Division of Criminal Justice Services (DCJS). It extends, until March 31, 2017, the provision requiring DCJS to notify each sex offender whose term of registration and verification would otherwise have expired prior to March 31, 2007 of the continuing duty to register and verify.
Section two amends subdivision one of section 168-h of the correction law, relating to the duration of registration and verification of sex offenders. This provision extends the annual registration requirement on level one sex offenders from twenty years to thirty years.
Section three amends subdivision eight of section 168-1 of the correction law, relating to the board of examiners of sex offenders. This provision is amended to provide that the minimum period of registration for a sex offender is thirty years.
Section four establishes the effective date.
Justification
This year marks the twentieth anniversary of Megan's law, which established the New York State sex offender registry. Under the 1996 law, level one sex offenders were required to annually register with DCJS for a period of ten years from the initial date of registration. In 2006, the law was amended to require these individuals to register for a total period of twenty years. This January, the first level one sex offenders registered under the law in 1996 will no longer be required to register.
These provisions have been essential in ensuring the safety of our communities, and should continue well into the future to protect our State's children. Therefore, it is crucial we extend the registration requirement on level one sex offenders for another ten years, requiring a total registration period of thirty years.
