Title of bill
An act granting the Lutheran Church of Our Savior Parish retroactive real property tax exempt status
Purpose
To grant the town assessor for the town of Brookhaven the authority to Accept an application for a real property tax exemption for the Lutheran Church of Our Savior Parish for the 2013-2014 assessment roll.
Summary of provisions
Section One authorizes the assessor of the town of Brookhaven, Suffolk County, to accept an application from the Lutheran Church of Our Savior Parish, for an exemption from real property taxes pursuant to Section 420-a of the Real Property Tax Law for the 2013-2014 assessment roll. The property is located in the Village of Patchogue. Upon acceptance of the RP 420-a exemption application by the Brookhaven Assessor, the Lutheran Church of Our Savior Parish will be entitled to the benefits of this exemption from all taxation with respect to the 2013-2014 tax roll. If the exemption is granted, the Lutheran Church of Our Savior Parish may be refunded any taxes paid and cancel any taxes, fines, penalties and interest remaining unpaid.
Section Two is the effective date.
Justification
The Lutheran Church of Our Savior Parish is a religious corporation, and is therefore entitled to tax exempt status, pursuant to Section 420-a of the Real Property Tax Law, which grants tax exempt status to the mandatory class of real properties in New York State. This legislation would allow the assessor to accept such application from the parish to grant such tax exemption as if said application had been filed with the Brookhaven assessor in a timely manner.
