Title of bill
An act to amend the navigation law, in relation to time restrictions on continuous pilotage on vessels transiting the Hudson River
Purpose or general idea of bill
The purpose of this bill is to amend Chapter 478 of the laws of 2015 regarding time restrictions on continuous hours of pilotage for vessels transiting the Hudson River.
Summary of specific provisions
Section one of the bill allows the board of commissioners of pilots to set an additional launch fee, communication fee, and mid-river launch fee to recoup the cost of operating a pilot launch and pilot station at Yonkers, to recoup the cost of portable electronic communication and navigation equipment carried aboard the vessel by the pilot, and to recoup the cost of operating a pilot launch and pilot station at Norrie Point. The fees shall be reviewed annually by the board of commissioners of pilots.
Section one also sets forth that when vessels transiting the Hudson River require a continuous pilotage of ten or more hours, two pilots will be added at the beginning of such transit, and the fee shall be the regular pilotage fee plus fifty percent for the second pilot. If a pilot is discharged at the mid-river station, and relieved by another pilot, the fee will not apply. A second pilot will not be required when the vessel anchors for at least eight hours such that the transit does not require a continuous pilotage of more than ten hours by one pilot.
Justification
Chapter 478 of 2015 established a surcharge on vessels piloted by Hudson River Pilots for the purposes of establishing a stable an equitable pension fund for the Hudson River Pilots. This legislation amends Chapter 478 of 2015 by changing the time restrictions on continuous pilotage on vessels transiting the Hudson River from eight to ten hours to maintain consistency with existing Navigation Law.
Prior legislative history
New bill.
Fiscal implications
None to the State.
Effective date
This act shall take effect on the same date and in the same manner as section 5 of chapter 478 of the laws of 2015.
