Title of bill
An act to amend a chapter of the laws of 2015 to legalize, validate, ratify, and confirm certain actions of the Oneonta Fire District relating to its operation, as proposed in legislative bills numbers S.4541 and A.7215, in relation to specification of Oneonta Fire District operations
Purpose or general idea of bill
This bill would enact a chapter amendment to chapter 412 of the laws of 2015 (S.4541) to clarify an end date of December 31, 2015, and that the ratification of the actions of the Oneonta fire district that this chapter of laws provides, would include all contracts and the calling and conducting of the 2015 annual election for fire district officers.
Summary of specific provisions
This bill would amend the unconsolidated law, to clarify an end date of December 31, 2015, and that the ratification of the actions of the Oneonta fire district that this chapter of laws provides, would include all contracts and the calling and conducting of the 2015 annual election for fire district officers.
The original bill would have simply ratified all previous acts of the Oneonta Fire District, from 2010 until the election of new commissioners in 2015, in order to provide legal status for ultra vires actions taken by an appointed and hold over board.
Justification
The Oneonta Fire District, a subdivision of the state located within the Town of Oneonta, Otsego County, appointed commissioners to fill vacancies in the time period of 2010-2014, and through error or omission, mistakenly failed to schedule elections each December subsequent to the appointment of commissioners for the voters to ratify the interim appointments as required by law.
As a result of these errors or omissions, by 2010 the Oneonta Fire District was without a quorum of elected commissioners, that would be legally empowered to approve and negotiate contracts and budgets and establish tax levies. The original legislation, enacted as chapter 412 of the laws of 2015, would validate the actions of the appointed commissioners of the fire district during the period of time in question, as if a quorum of duly elected commissioners was legally empowered to act.
This chapter amendment, negotiated and achieving a three-way agreement, will allow this important legislation to go forward, so that new commissioner elections can be held and fire protection can be effectively continued.
