Title of bill
An act to amend the general business law, in relation to requiring pet dealers to provide instructions on the care of small animals
Title of bill
An act to amend the general business law, in relation to requiring pet dealers to provide instructions on the care of small animals
Purpose or general idea of bill
This chapter amendment to chapter 557 of the laws of 2015 clarifies the obligation of pet retailers, to provide written instructions on the care of small animals sold as pets
Summary of specific provisions
Section 1 amends section 391-t of the general business law, as added by chapter 557 of the laws of 2015, to impose the obligation on pet retailers instead of pet dealers, and to further define a pet retailer as any person conducting a for-profit retail business of selling or offering small animals for sale to the public. Clarifies the acceptable contents and sources of such instructions. Replaces an obligation to file copies of the required instructions with the department of agriculture and markets with an obligation to keep such instructions on the premises
Section 2 provides that the act shall take effect on the same date and in the same manner as chapter 557 of the laws of 2015
Justification
Corrects a technical error in chapter 557 of the laws of 2015 which would have required pet dealers, not pet retailers, to provide instructions with the sale of small animals. Pet dealers are defined under state law as sellers of dogs and cats, and as such are not the appropriate sellers on whom to impose this obligation.
Prior legislative history
