Title of bill

An act to authorize St. Luke's Episcopal Church to file an application for exemption from real property taxes for certain assessment rolls

Purpose or general idea of bill

To exempt St. Luke's Episcopal Church, a religious corporation, from the liability for payment of certain general taxes of the 1992-1993 through 1999-2000 assessment rolls.

Summary of specific provisions

This bill would authorize and direct the New York City Department of Finance to accept applications for exemption from real property taxes pursuant to section 420-a of the real property tax law for the assessment rolls as to which 1992-1993 assessment rolls through 1999-2000 assessment rolls was the taxable status date. When satisfied that the St. Luke's Episcopal Church would otherwise have been entitled to said exemption, the NYC Department of Finance, upon approval by the city council of the city of the city of New York, may grant exemption from all taxation with respect to the subject tax rolls due and owing by such corporation on the effective date of this act and cancel taxes, fines, penalties and interest remaining unpaid, and make appropriation correction of the subject assessment rolls.

Justification

St. Luke's Episcopal Church owns property (Block 4654, lot 73) in Bronx, New York for which an application from exemption has been filed. However, because the date of the application for exemption was filed on June 5, 2001 the exemption would not apply to the 1992-1993 through 1999-2000 assessment rolls.

St. Luke's Episcopal Church, is a tax exempt corporation under the Internal Revenue Code, Section 501 (c) (3) and corresponding state and local codes. It is intended by this bill to undo the hardship suffered by this religious institution due to the imposition of real property taxes described above.

This legislation is similar to numerous other chapters of law in previous years.
