Title of bill
An act to amend the penal law, in relation to official misconduct of a public servant
Purpose
To establish that a public servant obtaining, arranging or providing a compensated position or public office that requires little or no actual attendance or work is guilty of official misconduct.
Summary of provisions
Section 1 amends section 195.00 of the penal law, as amended by chapter 906 of the laws of 1990, to provide that a public servant knowingly obtaining, arranging or providing for himself or another a compensated position or public office that requires little or no actual attendance or work is guilty of official misconduct.
Section 2 provides this act shall take effect immediately.
Existing law
This is a new provision of the penal law.
Justification
To deter corruption and help restore the public's trust in government, it should be established that public servants are guilty of a misdemeanor when they obtain or provide "no show jobs." Taxpayers should know they are only paying the salaries of public officials who actually work.
