Title of bill
An act to amend the agriculture and markets law, in relation to acts of animal cruelty in the presence of a child
Purpose
The purpose of this legislation is to amend the definition of child endangerment and other related statutes to include committing acts of animal cruelty in the presence of a child and to strengthen penalties for existing animal cruelty charges when committed in the presence of a child.
Summary of provisions
Section 1. Amends subdivision 1 and 3 of section 353-a of the agriculture and markets law, as added by chapter 118 of the laws of 1999.
Section 2. Sets the effective date.
Justification
Adults who commit acts of animal cruelty in the presence of a child inflict psychological damage on the minor who is forced to witness these crimes. They can also permanently imperil a still-developing minor's sense of judgment and ethical conduct. By increasing the penalty for animal cruelty when engaging in such cruelty in the presence of a child, this behavior can be curtailed and its consequences can be more thoroughly recognized.
