Title of bill
An act to authorize Salt and Sea Mission Church, Inc. to file an application for exemption from real property taxes and an exemption from water and sewer charges for certain assessment rolls
Purpose
This bill permits the City of New York to accept late applications for certain real property tax exemptions for the 2013 through 2016 assessment rolls and water and sewer charges for 2013 through 2016, and, if found eligible, to grant the exemptions and refund any excess payments by the tax-exempt organization.
Summary of specific provisions
Section 1 would authorize the commissioner of the Department of Finance of the City of New York to accept from the Salt and Sea Mission Church, Inc. an application for exemption from real property taxes pursuant to § 420-a of the Real Property Tax Law. If satisfied that the Salt and Sea Mission Church, Inc. would otherwise have been entitled to said exemption, the Commissioner of the Department of Finance, upon approval by the City Council of New York City, may grant exemption from all taxation with respect to the subject tax rolls and cancel taxes, fines, penalties and interest remaining unpaid, and make appropriate correction of the subject assessment rolls.
Section 2 would authorize the commissioner of the Department of Environmental Protection of the City of New York to accept from the Salt and Sea Mission Church, Inc. an application for exemption from water and sewer charges taxes pursuant to § 420-a of the Real Property Tax Law. If satisfied that the Salt and Sea Mission Church, Inc. would otherwise have been entitled to said exemption, the Commissioner of the Department of Environmental Protection, upon approval by the City Council of New York City, may grant exemption from all water and sewer charges and cancel charges, taxes, fines, penalties and interest remaining unpaid, and make appropriate correction of the subject assessment rolls.
Section 3 states that the act will take effect immediately.
Justification
The Salt and Sea Mission Church, Inc., a not-for-profit corporation, acquired title to a property in the City of New York, borough of Brooklyn, following hardship faced after Hurricane Sandy. The corporation would otherwise be entitled to a tax exemption and water and sewer charges if such corporation had acquired the property on or before the taxable status date and filed the appropriate paperwork. It is intended by this bill to undo the hardships that will be suffered if the organization is required to pay the property taxes and water and sewer charges due as described above.
