Title of bill

An act to amend the real property law, in relation to the duty of landlords to verify the licensure of massage therapist tenants

Purpose

This bill seeks to impose a duty on the landlords to verify the licensure of a massage therapist tenant prior to entering into a lease agreement with said tenant.

Summary of provisions

Section 1 of the bill to amends the real property law and adds section 235-h that requires a landlord to verify that a tenant is a licensed massage therapist when that tenant intends to engage in the practice of massage therapy prior to entering into a lease agreement with said tenant.

Section 2 provides that any landlord that is proven by substantial evidence to have failed to verify the tenant's licensure is subject to a civil penalty of 1,000 dollars.

Section 3 provides the effective date.

Justification

There has been a substantial increase in the amount of massage parlors that have set up shop under the guise of 'massage therapists' and promoting prostitution and illegal sexual activities. This bill seeks to ensure that landlords, as members of the community, ensure that any tenant who it enters into a lease with is a validly license massage therapist. This will discourage landlords from renting their premises to a tenant who intends to practice illegal massage therapy.
