Title of bill
An act to amend the correction law, in relation to authorizing the Fulton county correctional facility to also be used for the detention of persons under arrest being held for arraignment in any court located in the county of Fulton
Purpose
To make the arraignment process more efficient in Fulton County through the use of the Fulton County jail, similar to arrangements authorized on behalf of numerous other counties.
Summary of provisions
Section 1 amends Section 500-a of the Correction Law by adding a new subdivision 2-o that allows the Fulton County jail to be used for the detention of persons under arrest being held for arraignment in any court in Fulton County.
Section 2 amends Section 500-c of the Correction Law by adding a new subdivision 21 to provide that in Fulton County all provisions of such section shall apply equally in any case where the sheriff is holding a person under arrest for arraignment prior to commitment as if such person had been judicially committed to the custody of the sheriff and such person may be held in the Fulton County correctional facility
Justification
The Fulton County Board of Supervisors is requesting legislation which would permit the use of the Fulton County jail by various police agencies as a holding cell for pre-arraigned prisoners. This type of authority has already been granted to numerous counties throughout the State. This option will make the arraignment process more efficient and cost-effective throughout the county, allowing for the best utilization of resources and staff allocations.
