Title of bill
An act to amend the executive law, in relation to establishing the Suffolk county felony youth part demonstration program
Purpose or general idea of bill
Creates the Suffolk County felony youth part (SCFYP) demonstration program and allows the SCFYP courts to access the services provided by the Office of Children and Family Services (OCFS).
Summary of specific provisions
Section 1.
1. Requires the OCFS Commissioner and Commissioner of Criminal Justice Services to create the SCFYP demonstration program. Allows the court discretion in choosing individuals to participate in the program. Requires the program to be funded in the same manner as Family Court, per Section 529B of the Executive law
2. Requires a written evaluation of the program in two years from the date of establishment of this program.
Section 2. Effective Date
Justification
Suffolk County has established a innovative court with wraparound services called the Suffolk County Youth Part. Under the program, youth are diverted from criminal courts and given resources to rehabibilitate. The court pairs the defendants with social workers, drug counselors, probation officers, lawyers and advocates. Defendants who complete the program plead to a lesser charge and may get their record sealed.
Since the start of the program, less than a quarter of the defendants who participated in the program have committed new crimes. This program would be greatly improved if it had access to the services provided to family court and other specialty courts through the Office of Children and Family Services (OCFS).
Many youth have co-occuring mental health and substance abuse problems. OCFS has the experience and existing structure to provide services for young individuals facing the court system. If successful, this demonstration program could be expanded to the rest of the state.
