Companion bill
The same bill in the other chamber. A bill becomes law when one version passes both houses and the governor signs it, so either number can carry it.

Title of bill
An act to amend the mental hygiene law, in relation to the powers of the commissioner of the office of mental health
Purpose or general idea of bill
Requires the Commissioner to report to the Legislature on a quarterly basis the number of assaults or overt acts by persons resulting in injury to any staff member or patient and to list the degrees of injuries within one of four defined categories.
Summary of specific provisions
Section 1 of the bill requires the Commissioner of OMH to develop clear and detailed definitions of at least four graduated categories of injuries. Further requires the Commissioner to report to the Legislature on a quarterly basis the number of assaults or overt acts by persons resulting in injury to any staff member or patient and to list the degrees of injuries within one of four defined categories.
Justification
Currently New York State operates four forensic facilities. Central New York Psychiatric Center, Kirby Forensic PC, Mid-Hudson PC, Rochester Regional Forensic Unit, employed here are individual working as Security Hospital Treatment Assistants (SHTAs). These individuals employed in these facilities are subjected often to extremely dangerous working conditions. However, as OMH does not release any date related to the number of incidents located in these facilities it is difficult to ascertain the extent of this problem. This legislation simply seeks to require OMH to create unique categories of incidents and to report to the Legislature this information.
