Title of bill

An act to amend the agriculture and markets law and the public health law, in relation to establishing procedures for the growing of industrial hemp

Purpose

To establish procedures for the growing of industrial hemp.

Summary of provisions

§ 1 is the legislative intent

§ 2 amends the title of article 29 of the agriculture and markets law

§ 3 adds a new article 29-a to the agriculture and markets law

§ 4 amends section 3397-b of the public health law

§ 5 states the effective date

Justification

In 2014 New York State joined over 20 other states in establishing a pilot program for the growth of industrial hemp, as authorized by the 2014 Federal Farm Bill. The pilot regulations limit institutions of higher education to growing the crop as part of the program. While the pilot program was a strong first step in identifying what cultivars of hemp will grow the best in the state, New York is still behind many other states in embracing this industry.

This bill will establish a licensing system for farmers to grow industrial hemp and will direct the Department of Agriculture and Markets to establish regulations for the growing of industrial hemp. Allowing for the full scale growth of industrial hemp will put New York at the forefront of the rapidly growing hemp industry alongside state such as Colorado, Kentucky and Vermont. Hemp has the potential to be a lucrative cash crop for our local farmers and establish niche markets that will only aid in the economic revitalization of upstate.
