Title of bill
An act in relation to providing state aid to a certain school district; and providing for the repeal of such provisions upon expiration thereof
Purpose
This bill provides state aid to the Beacon City School District in order to mitigate the effect of certain property being removed from their assessment rolls due to a religious exemption.
Summary of provisions
Section 1: Outlines that certain school districts in Dutchess County shall be granted state aid in the event of previously taxable property being removed from the assessment roll of taxable property due to the acquisition by a religious corporation eligible for a tax exemption under Section 462 of the Real Property Tax Law.
Aid payable to the school district by the state for the first year shall be 100% of the total amount of taxes which would have been collected had it not been for the acquisition of such property by such religious corporation, and then 80%, 60%, 40%, and 20% for the second, third, fourth, and fifth years after, respectively.
Furthermore, increases or decreases in the level of assessment shall be taking into account when determining how much aid is owed to such school district.
The chief fiscal officer of such school district to apply for such aid to the Commissioner of Education in the form prescribed, and that the state aid shall be paid upon audit and warrant by the state comptroller.
The term "school tax district" is defined as a city school district located within Dutchess County where 0.6% or more of their taxable assessed valuation was granted a religious exemption pursuant to Section 462 of the Real Property Tax Law due to being acquired by a religious corporation and where such exemption was approved between February 28, 2015 and July 2, 2016.
Section 2: This act shall take effect immediately and shall be deemed repealed December 31, 2021.
Justification
The Watchtower Bible & Tract Society of new York, Inc. has recently acquired the Rivercrest apartments property, assessed at $31 million. Currently, 44% of this property is now tax exempt due to it being used for residential purposes by officiating clergymen of the group. It is expected that by next year, over 99% of the property will be tax exempt. Losing over 99% of a property assessed at $31 million would be a loss of over 1.5% of Beacon City School District's total taxable assessed property. This bill would help mitigate the effects felt by Beacon City School District as well as the district's residents.
