Title of bill

An act to amend the education law, in relation to timely submission of an application for licensure of behavior analysts

Purpose

This bill would extend the period of time for an individual to submit an application to SED for certification as a licensed behavioral analyst.

Summary of provisions

Section 1 The first section provides that an individual who meets the requirements for a license or certification as a licensed behavior analyst or a certified behavior analyst assistant, except for examination, experience and education, and who is certified or registered by a national certifying body having certification or registration standards acceptable to the commissioner, may be licensed or certified, without meeting additional requirements as to examination, experience and education, provided that such individual submits an application to the department within one year of the effective date of this legislation which amends section of the Education Law.

Section 2 sets forth an immediate effective date.

Justification

In 2013 legislation was enacted to create the licensure of behavioral analysts in New York. The legislation provided for a two year period for those individuals who already possessed certification from the Behavioral Analyst Certification Board (BACB), the only certification board for Behavioral Analysts, so that they could be licensed immediately. That two year period expired on January 10, 2016. This legislation would extend that period for an additional year from the effective date of this bill.

The original two year "grandfathering" period did not take into account the amount of time needed for individuals who had already started the process to complete their applications with the State Education Department. Giving those individuals more time to do so, would be in keeping with the original intent of the 2013 legislation, but treat those individual behavioral analysts, already certified by the BACB, and who had already begun the process to be certified under New York State law, ample time to complete that process, without having to start all over again under new guidelines.
