Title of bill
An act to amend the tax law, in relation to granting a tax credit for wages and salaries paid by qualified film production companies and qualified independent film production companies for services performed on a qualified film in the counties of Rensselaer, Saratoga, Warren and Washington
Purpose
Provides for business franchise and personal income tax credits for wages paid by film production companies for services conducted on films in the counties of Rensselaer, Saratoga, Warren and Washington
Summary of provisions
Section 1 amends paragraph 5 of subdivision a of section 24 of the tax law, as amended by section 1 of part JJ of chapter 59 of the laws of 2014.
Section 2 establishes the effective date.
Justification
The Upstate NY post-production and production cost tax credit for qualified labor expenses was designed to stimulate film production and independent film production in our upstate counties. Due to the structure of economic development councils, the counties of Rensselaer, Saratoga, Warren and Washington were not originally included in the list of eligible counties as they were part of the Capital District Economic Development Council. Subsequently, the counties of Albany and Schenectady were added via the 2014 budget. This bill will enable Rensselaer, Saratoga, Warren and Washington counties to join with their neighboring upstate counties as eligible for production film tax credits on qualified labor incurred in the counties.
