Title of bill
An act to amend the public health law, in relation to the Kings county health care facility transformation program
Purpose
This bill would ensure that the $700 million in capital grants for the above-mentioned program be awarded pursuant to an open and transparent process.
Summary of provisions
Section one of the bill would add a new subdivision five to section 2825-a of the Public Health Law to require that the agreement of the commissioner of health and the president of DASNY include:
*a schedule or timetable for the issuance of the request for applications, the receipt of applications and the awarding of the grants; *a description of the process or procedures for determining the amounts to be awarded to each applicant; and
*a description of how the grants will be distributed, administered and monitored.
The section would also require that a public posting of all applications received and the amount of the grant requested by, or to be awarded to, each applicant; and that at least one public hearing in the county of Kings be held prior to the awarding of the grants.
Section two of the bill provides that the act shall take effect immediately.
Justification
Under the current law, the capital grants to be awarded pursuant to the Kings county health care transformation program will be made by the commissioner of Health and the president of DASNY without competitive bidding.
As such, there is no way for the residents of Brooklyn or other interested parties to know or learn the identity of the applicants, whether the applicants in fact are eligible to receive a grant or the amount of the grant until after the awards have been made.
This bill would require a more open and transparent process for the awarding of capital grants under this program.
