Title of bill
An act to provide for an increased death benefit for the survivors of a deceased police officer
Purpose
This legislation would provide an increased death benefit for the survivors of Theodore Raffel, who was a Southampton Village police officer for 19 years, 364 days and 15 1/2 hours at the time of this death.
Summary of provisions
Special Act to increase the death benefit paid to the beneficiary of deceased police officer, Theodore Raffel.
Justification
On June 1, 1986, Officer Theodore Raffel, Sr. died just 8 1/2 hours short of his 20th year of service with the Southampton Village police department. As a result of his untimely death, Officer Raffel was not able to vest his pension so his spouse was only entitled to receive a one-time death benefit payment from the New York State and Local Police and Fire Retirement System. If he had lived just a few more hours, however, his spouse would have been eligible to receive a monthly retirement benefit for the rest of her life. This legislation attempts to provide some equity for the Raffel family by creating an additional death benefit that would equal the sum of the contributions paid to the New York State and Local Police and Fire Retirement by the Village of Southampton on Officer Raffel's behalf, less any sums previously paid to his beneficiary. Such balance would have 5% interest applied for the period 6/1/86 - 5/31/16. It is estimated by The New York State and Local Police and Fire Retirement System that this additional death benefit would total approximately $171,000.

Fiscal implications
The New York State and Local Police and Fire Retirement System estimates the shared cost of the additional death benefit to be approximately $171,000 that would be borne by the State of New York and all participating employers of the New York State and Local Police and Fire Retirement System.
