Title of bill

An act to amend the social services law, in relation to making care and services provided by licensed mental health practitioners eligible for coverage under the Medicaid program

Purpose

The purpose of this bill is to allow individuals to receive Medicaid program coverage for receiving care and services from licensed mental health practitioners.

Summary of specific provisions

This bill would amend subdivision 2 of section 365-a of the social services law by requiring all care and services provided by mental health practitioners licensed under section 8402 of the education law, as well as care and services provided in a hospital or clinic facility referred to in paragraph C of subdivision 2 of section 365-a of the social services law, to be covered under the New York State Medicaid program.

Justification

According to the National Institute of Mental Health, approximately one in four American adults suffer from a diagnosable mental illness, making the work performed by mental health professionals all the more crucial. Individuals suffering with mental health disorders make up a large number of New Yorkers who need Medicaid assistance to cover their medical expenses. The New York State Department of Health's website states that Medicaid does not cover all services provided by licensed mental health practitioners. The status quo of excluding mental health practitioners from recognized providers within the Medicaid program results in undue hardship for individuals, families, and our communities. Access to Medicaid assistance should be open to everyone and individuals should be able to receive treatment for behavioral health disorders without facing the pressure of burdensome medical expenses.
