Title of bill
An act to amend the tax law, in relation to authorizing the county of Fulton to establish hotel and motel taxes
Purpose
To give Fulton County the same authority that most other counties already have to enact a local law establishing an occupancy tax on hotel or motel rooms.
Summary of provisions
The bill would add a new Section 1202-dd to the Tax Law to authorize Fulton County to adopt a local law which imposes a tax, not to exceed 4% of the per diem rental rate, on persons occupying hotel or motel rooms in such county.
Revenues from this tax will be allocated for the promotion of tourism development, economic development and other directly related and supporting activities.
Each enactment of such a local law may provide for the imposition of the tax for a period of time no longer than three years.
Justification
The Fulton County Board of Supervisors has requested home rule legislation to enable the County to establish a hotel/motel occupancy tax. Such local bed taxes are currently assessed in at least 50 of the 62 counties in New York State. Most recently, the State granted such authority to Delaware and Franklin counties in 2015. The County Board indicates that a bed tax would generate a steady revenue stream that will help sustain vital services and relieve the burden on property taxpayers. Revenues would be allocated for the promotion of tourism development and economic development.
