Title of bill
An act granting retroactive membership in the New York state and local employees' retirement system to Adam Markel
Purpose
This bill would grant Adam Markel Tier 2 status in the New York State Police and Fire Retirement system upon application.
Summary of provisions
Section 1: Authorizes Adam Markel to apply for retroactive membership in the New York State and Local Employees' Retirement System with an effective date of September 5, 2006. Once an application is filed with the head of the New York State Police and Fire Retirement system, within one year from the effective date of this act, such service credit will be transferred.
Section 2 states that no contributions made to the New York state Police and Fire Retirement System by Adam Markel should be returned or refunded to him.
Section 3 states that all past service costs of implementing the provisions of this act shall be borne by the State University of New York at Buffalo.
Section 4: Provides that this act shall take effect immediately.
Justification
Adam Markel was a part-time employee with the State University of New York at Buffalo from September 5, 2006 until April 14, 2009. However, through no fault of his own, he did not become a member of the New York State and Local Employees' Retirement System during that time. This legislation would afford Mr. Markel the ability to establish membership in the retirement system as of September 5, 2006 thereby correcting this oversight. It should be noted that all past service costs of implementing the provisions of this act would be borne by the State University of New York at Buffalo.
