Title of bill
An act to amend the surrogate's court procedure act, in relation to people with intellectual disabilities
Purpose or general idea of bill
To amend Article 17-A of the Surrogate's Court Procedure Act (the "Act")entitled "Guardians of Mentally Retarded and Developmentally Disabled Persons" to replace all reference to "mentally retarded," "mental retardation" and "office or commissioner of mental retardation".
Summary of specific provisions
Section 1 through 15 of the bill amend the Act to eliminate all reference to "mentally retarded," "mental retardation" and "office or commissioner of mental retardation" and replaces this language.
Section 16 is the effective date.
Justification
Disability advocates worked tirelessly to persuade state and federal governments to end official use of "retarded". New York was amongst the many states to remove this language from departments and regulations.
However, this language remains in Article 17-A of the Surrogate's Court Procedure Act.
This legislation will remove all reference to "mentally retarded" or "mental retardation" from the Act and replace it with current and more appropriate language.
