Title of bill
An act to amend the workers' compensation law and the public health law, in relation to occupational safety and health prevention centers located at the city university of New York Barry Commoner Center for Health and Environment and the occupational health clinical center at the Upstate Medical University of the state university of New York
Purpose
To establish occupational injury and disease prevention centers at the City University of New York Center for the Biology of Natural Systems and the occupational health center at the Upstate Medical University of the State University of New York.
Summary of provisions
Section I of the bill amends subdivision 3 of section 151 of the work- ers' compensation law, as added by section 22 of part GG of chapter 57 of the laws of 2013, to include occupational illness and injury prevention centers pursuant to title six of article 29-D of the public health law. It also adds that the state shall appropriate funds annually in an amount not less than the amount made available in the previous state fiscal year.
Section II of the bill amends article 29-D of the public health law by adding a new title 6.
Section III of the bill amends section 2490 of the public health law, as amended by chapter 139 of the laws of 2009, to establish an oversight committee for occupational health clinics and prevention centers.
Section IV of the bill amends section 2490-a of the public health law, as added by chapter 139 of the laws of 2008, to establish advisory committees for occupational health centers and prevention centers.
Section V sets forth the effective date.
Justification
This bill would establish occupational injury and disease prevention centers at the City University of New York Center for the Biology of Natural Systems and the occupational health center at the Upstate Medical University of the State University of New York. These prevention centers would identify, promote and organize opportunities for the integration of early detection of occupational illnesses and injuries into the prevention services required of health insurance plans under the federal Affordable Care and Patient Protection Act of 2010.
The centers would also identify, locate and notify workers who are at high risk of lung cancer due to past exposure to asbestos, silica, diesel exhaust and other lung carcinogens. Such findings would allow the prevention centers to coordinate with occupational safety and health clinics and workers to take the necessary steps to prevent the onset of any illness or injury.
Passage of this bill would require that the prevention centers gather all available occupational health hazard data sources in New York. In doing so, the centers would be better able to use the data for the development of prevention projects designed to reduce injury and illnesses.
