Title of bill
An act to amend the alcoholic beverage control law, in relation to the issuance of a retail license for on-premises consumption for certain premises
Purpose
This bill will permit the authority to issue a retail license for on-premises consumption in an establishment that is within two hundred feet of a place of worship and situated on Elmwood Avenue.
Summary of specific provisions
Subdivision 7 of section 64 of the alcoholic beverage control law is amended by adding a new paragraph (e-8) which permits for on-premises conception for a premise, located in the bill by metes and bounds, and is within two hundred feet of a place of worship.
Justification
A restaurant on Elmwood Avenue (Pano's) is within 200 ft of a place of worship. The synagogue is spearheading the effort to help the restaurant obtain a liquor license. They have sent letters in support to the SLA encouraging them to except Pano's from the 200 ft rule. SLA does not have this authority and this bill is necessary to allow the license to proceed. On the same block as Pano's is a liquor store and two additional bars that have a full liquor license. The synagogue has stated that they are not harmed by the licenses and would actually encourage the further issuance of such licenses to responsible business owners. They see this as not only being "neighborly" but helping to boost businesses within the community of which they are a part.
