Title of bill

An act to authorize Christopher Dyroff to file an application for retroactive membership in the New York state and local employees' retirement system

Purpose

To reclassify Christopher Dyroff's membership in the New York state and local employees' retirement system

Summary of provisions

Section 1: Authorizes Christopher Dyroff to file an application for Tier IV membership in the New York State Retirement System.

Section 2: All past service costs of implementing the provisions of this act shall be borne by the town of Highlands, and there shall be no refund of member contributions to Christopher Dyroff.

Section 3: Effective Date.

Justification

When Mr. Dyroff joined the Town of Highlands Planning Board in 2008, the Town did not provide him with the opportunity to opt into the New York State and Local Employees' Retirement System (NYSRS). In May of 2015 Mr. Dyroff was hired by the Town of Haverstraw as a greenskeeper and was enrolled in the NYSRS. This legislation would allow Mr. Dyroff to receive the Tier status he should have received if the Town of Highlands offered membership in the Retirement System when he first became employed by the Town.
