Title of bill

An act to amend the executive law, in relation to establishing the office of community living; and to repeal certain provisions of the executive law, the education law and the private housing finance law relating thereto

Purpose

To provide a focal point within state government to address the community integration needs of people with disabilities by subordinating disparate programs under an office of community living.

Summary of provisions

Section 1 establishes the purpose, powers and responsibilities of the office of community living; powers of the most integrated setting coordinating council; responsibilities of independent living centers and the New York access to home program; and provides for the transfer of the New York access to home program to the office of community living. Section 2 repeals article 25 of the executive law. Section 3 repeals section 559 of the executive law. Section 4 repeals article 23-A of the education law. Section 5 repeals article 25 of the private housing finance law. Section 6 provides the effective date.

Justification

The 2015-16 state budget required the office for the aging to conduct a feasibility study on the establishment of an office of community living (OCL). The report identified gaps in existing services and areas for improvement in the coordination of service delivery, which suggests that the creation of an OCL as an independent office dedicated to the needs of the disability community would be beneficial.

The office would bring together the independent living centers from the state education department, access to home program from homes and community renewal, the technology-related assistance for individuals with disabilities program from the justice center for the protection of people with special needs and community integration programs from the department of health. It would also assume coordination of the most integrated setting coordinating council currently under the auspices of the office for people with developmental disabilities. Such an office would ensure that people with disabilities receive the necessary support and services without being forced into institutions.

Legislative history

None.

Effective date

April 1, 2017, provided that the governor is authorized to take any necessary steps to effectuate the transfer of programs to the office of community living.
