Title of bill

An act to authorize Moses Jacobowitz Charitable Foundation to file an application for exemption from water and sewer charges for certain assessment rolls

Purpose

The purpose of this bill is to authorize the building located at block 1750, Lot 21 in the borough of Brooklyn of the City of New York, to file a retroactive application for the exemption from water and sewer charges for certain assessment rolls.

Summary of specific provisions

Section 1 authorizes the NYC Department of Environmental Protection to accept an application for exemption from water and sewer charges pursuant to Section 420-a of the real property tax law for the 2014 through 2015 assessment rolls from the not-for-profit corporation located at Block 1750 Lot 21. This section further requests that the NYC Department of Environmental Protection review the application as if it had been received on or before the taxable status date established for these assessment rolls. If satisfied that such corporation would otherwise have been entitled to said exemption, the Commissioner of the NYC Department of Environmental Protection, upon approval by the City Council of New York City, may grant exemption from all water and sewer charges with respect to the subject tax rolls and charges, taxes, fines, penalties and remaining unpaid interest, and make appropriate correction to the subject assessment rolls.

Section 2 is the enacting clause.

Justification

Management at the building in question failed to pass the notice to renew the synagogue's exemption status. As a result their exemption status from the payment of water and sewer charges in connection with the property lapsed. Once realizing their status has changed they immediately re-applied for the exemption status but such renewal is only effective from the date of the application not retroactive. The intention of this bill to undo the hardships that will be suffered if the organization is required to pay the charges, interest and penalties due.
