Title of bill
An act to amend the not-for-profit corporation law, in relation to exempting Prospect Terrace Fire Company, Inc. from the requirement that the percentage of non-resident fire department members not exceed forty-five percent of the membership
Purpose
Relates to exempting Prospect Terrace Fire Company, Inc. from the requirement that a percentage of non-resident fire dept members not exceed 45% of the membership.
Summary of provisions
Section 1. Subparagraph 3 of paragraph (c) of section 1402 of the not-for-profit corporation law, as amended by chapter 149 of the laws of 2014.
Section 2. this act shall take effect immediately.
Justification
Prospect Terrace Fire Company is a small, but busy fire department located in the Southwest Corner of the Town of Dickinson. Its location is strategic to provide protection to that area of the town as well as giving mutual aid to the adjoining areas. Similar to other small departments, the company is finding it difficult to recruit a sufficient number of members from within their community. Since fire corporations are not included in Town Law 176, Prospect Terrace Fire Co. is not able to apply for a waiver to the 45% membership residency requirements. This bill would allow Prospect Terrace Fire Co. to elect or appoint nonresident members to any office in the corporation with all powers, duties, immunities, and privileges as those resident members.
