Title of bill

An act to authorize Patricia Gill-Davanzo Tier IV status in the New York state and local employees' retirement system

Purpose or general idea of bill

To reclassify Patricia Gill-Davanzo as a member of Tier IV of the New York State and Local Employees' Retirement System.

Summary of specific provisions

Grants Patricia Gill-Davanzo retroactive Tier IV status in the New York State and Local Employees' Retirement System.

Justification

Ms. Gill-Davanzo was employed with the North Babylon Union Free School District beginning on June 16, 1993. For reasons not ascribable to her own negligence, Ms. Gill-Davanzo was not offered membership in the New York State and Local Employees' Retirement System on June 16, 1993 as a Tier IV Member. Having begun her employment with the North Babylon Union Free School District on June 16, 1993, Ms. Gill-Davanzo is entitled to every right, benefit and privilege which would have been available to her at that time in accordance with Tier IV status.

Because Ms. Gill-Davanzo was not given the information necessary to become a member of the New York State and Local Employees' Retirement System with Tier IV status at the time of her employment, she was subsequently placed into Tier V.

Ms. Gill-Davanzo has been employed with the North Babylon Union Free School District as a school nurse since June 16, 1993.

Prior legislative history

None.

Fiscal implications

The Office of the New York State Comptroller, Employees' Retirement System has calculated an estimate which is included within this legislation. There will be an immediate past service cost of approximately $17,000 which will be borne by the North Babylon School district as a one time payment.

Effective date

This act shall take effect immediately.
