Title of bill
An act to amend the town law and the public officers law, in relation to authorizing the town justice of the town of Allen, county of Allegany, to be a nonresident of such town
Purpose
The purpose of this bill is to authorize the town justice of the Town of Allen, located in Allegany County, to be a nonresident of the town.
Summary of provisions
Section 1: Amends Section 23 of the Town Law by adding a new subdivision 30, which states that in the Town of Allen, Allegany County, the person performing the function of Town Justice need not be an elector of the town.
Section 2: Amends Section 3 of the Public Officers Law by adding a new subdivision 65.
Justification
This legislation was requested by the Town of Allen, county of Allegany, in Town Resolution number 26-2016.
The office of Town Justice in the town is vacant and there are no residents of the town who are ready, willing or able to serve as Town Justice. This legislation is therefore necessary to ensure that the position can be filled by someone who is qualified and able to serve in this vital position.
