Title of bill

An act to amend the social services law, in relation to the Medicaid evidence-based benefit review advisory committee

Purpose

To ensure the Medicaid Evidence Based Benefit Review Advisory Committee is reviewing coverage status as originally intended.

Summary of provisions

Section one amends Social Services Law § 365-d to repeal language requiring the Department of Health to make a determination as to whether a sufficient body of evidence exist to warrant committee deliberation and to require the Department to post on its website any programmatic changes to benefits that do not rise to the level of a material change which would warrant committee review.

Section two provides that the act shall take effect immediately.

Justification

The Medicaid Evidence Based Benefit Review Advisory Committee ("Committee"), adopted as part of the SFY 2015-16 budget, was originally proposed to ensure decisions regarding Medicaid coverage of medical technologies, services and procedures were made with ample input and transparency. Modeled after the Drug Utilization Review Board which reviews and makes recommendations to the Department on changes to pharmaceutical benefits under the program, this process was envisioned to open the Department's health technology assessment process in a similar manner, creating needed transparency and accountability.

Despite provisions establishing the Committee being effective as of April 1, 2015, the Department has continued to use the dossier process it established prior to enactment the Committee on the grounds that the Committee process is only to be utilized if, upon assessing the dossier evidence, the Department determines the matter warrants Committee Review. Thus, this legislation would amend provisions adopted through the budget to ensure all material changes in coverage status are reviewed by the Committee.
