Title of bill
An act to establish a blue ribbon commission on fair competition in the outdoor recreation industry; and providing for the repeal of such provisions upon the expiration thereof
Purpose
A blue ribbon commission on competitive issues relating to the public ownership of outdoor recreational facilities shall be established to examine where such facilities enjoy unfair competitive advantages and to make recommendations regarding methods to address any such unfair competitive advantages.
Summary of provisions
Section one of the bill officially establishes the blue ribbon commission and contains the subject areas to be examined and the composition of the membership of the commission, as well as its powers and duties. Additionally, section one requires the commission submit a report to the governor and the legislature of its findings, conclusions and recommendations.
Section two of the bill provides for the New York State Empire State Development Corporation, and all other departments and agencies of the state, to assist the commission with such facilities, assistance, and data as will allow the commission to carry out its functions.
Section three of the bill provides for an immediate effective date and an expiration date of January 1, 2018.
Justification
The outdoor recreation industry is an important segment of the economy in New York State, with the vitality of many of our families, businesses and communities reliant on the success of the industry.
With that said, this is a sensitive matter that encompasses conflicting interests in many areas throughout the state. While I appreciate the positive impact state funds have in supporting the many parks, golf courses, ski slopes, camping facilities, etc. across New York State, it is also important that we find a balance that does not undermine the private sector's ability to do business and discourage continued private investment in the recreation and tourism industries.
This legislation will keep the state from inadvertently hurting small businesses, and help find solutions that can level the playing field, thus allowing our private sector to remain competitive.
Legislative history
This is a new bill.
Fiscal implications
The fiscal implications of this bill for the State will be minimal, as members of the commission will not receive compensation for their services, only their actual and necessary expenses incurred in the performance of their official duties.
Effective date
This act shall take effect immediately.
