Title of bill

An act to amend the public health law, in relation to safe patient handling in schools operated by the office for people with developmental disabilities

Purpose or general idea of bill

This legislation seeks to clarify that the Safe Patient Handling Act intended to cover developmental centers and not home or day habilitation programs.

Summary of specific provisions

Section 1 amends Subdivision 1 of section 2997-h of the public health law to change the definition of health care facility as it relates to mental hygiene law.

Section 2 is the effective date.

Justification

The intent of the Safe Patient handling program was to include only developmental centers which are significantly larger than day programs. While MHL 1.03 contains relevant information it also may be interpreted too broadly could catch intermediate care facilities, day habilitation programs, or individuals homes. By using MHL 15.03 we would clarify the intent of this act to cover developmental centers and not these smaller locations.
