Title of bill

An act to amend the agriculture and markets law, in relation to dog attacks

Purpose or general idea of bill

This legislation would change the dog bite statute to remove the one bite standard and change how liability is assessed.

Summary of specific provisions

Section 1 of this bill removes the word dangerous dog and changes that to caused injury to a person, companion animal, farm animal or domestic animal. Further this section changes that any owner of a dog shall be liable for all injuries and damages suffered by any person who is bitten by the dog regardless of the former viciousness of the dog, or the dog owner's knowledge of that viciousness.

Justification

New York currently employs a one bite statute that severely limits the civil liability afforded to individuals who are bit by a dog. This legislation seeks to address this issue by changing the statute from dangerous dog to a broader definition to one that caused injury. Further the liability changes encompassed in this law would allow for greater recourse for victims of dog bites by creating a reasonable and appropriate statute.
