Title of bill

An act to amend the executive law, in relation to authorizing certain transfers of public employees in the unclassified service

Purpose of the bill

To facilitate the transfer of certain employees in the unclassified service to the Business Services Center ("BSC"), this bill would authorize the transfer of such employees to the Office of General Services ("OGS").

Summary of provisions

This bill would amend the Executive Law to authorize the transfer of certain employees in the unclassified service to OGS in conjunction with the transfer of an agency's financial and human resources functions to the BSC.

Justification

The BSC was established as a business unit of OGS in 2012 to provide for shared services to standardize human resources and financial transactions for executive State agencies. Its mission is to increase efficiencies, lower costs, and support agencies as they focus on core mission activities. By centralizing transactional activities, the goal of the BSC is to process such transactions faster and more efficiently with attention to customer service and to simplify and streamline the processing of such transactions. As State agencies transition to the BSC, agency employees substantially engaged in the performance of duties associated with such transactions are being transferred to OGS.

As part of the transition to the BSC, certain employees that are in the unclassified service will be transferred to OGS. The transfer of such employees is not currently covered by transfer provisions of the Civil Service Law. This bill would provide the legal authority to make the necessary transfers and would promote the increased efficiencies and cost savings associated with transferring routine functions to the BSC.

Prior legislative history

This is a new bill. In 2014, a similar provision was included in the enacted budget (L. 2014, c. 55, pt. H, subpt. C, § 3-a) for the transfer of Division of Military and Naval Affairs employees. In 2015, a similar provision was included in the enacted budget (L. 2015, c. 55, pt. C) for the transfer of State Police employees.
