Title of bill

An act to amend the civil service law, in relation to long term care insurance for state and retired state employees

Purpose of the bill

This bill would amend the Civil Service Law ("CSL") to provide that the president may rather than being required to - establish a long-term care insurance plan for public employees and retirees, eliminating the mandate to provide such insurance.

Summary of provisions

Section 1 of the bill would amend subdivision 1 of section 172 of the CSL to provide that the president is authorized to establish a long-term care insurance plan, thereby making it discretionary on the president's part.

Section 2 of the bill would amend section 173 of the CSL to addresses the requirements for purchasing long-term care insurance if the president so chooses.

Section 3 of the bill provides that the bill shall take effect immediately.

Justification

Pursuant to Article 11-A of the CSL, the President of the State Civil Service Commission is directed to provide a long-term care insurance plan to public employees and retirees through the New York State Public Employee and Retiree Long Term Care Insurance Plan ("NYPERL"). NYPERL's existing carrier, MedAmerica Insurance Company of New York ("MedAmerica"), notified the Department of its intent to terminate all services under its agreement with the State upon the contract expiration date of April 30, 2016. The market for group long-term care insurance is now limited to one carrier whose future in this market segment is uncertain. In addition to NYPERL, all New York State residents have the option of purchasing individual long-term care insurance through the New York State Partnership for Long-Term Care managed by the Department of Health.

No State funds are used to pay for NYPERL programmatic costs. Given the absence of State financial support, the extremely limited market for group coverage, and the availability of coverage through the individual market, the Department of Civil Service ("Department") recommends legislation to remove the mandate to establish such insurance and replace it with authorization language. While the Department is issuing a new Request for Proposals seeking a new carrier, this amendment would address the market conditions and better position the agency in the likely event that the Request for Proposal does not yield a viable new carrier.
