Title of bill

An act to amend the penal law, in relation to making false statements to district attorneys, assistant district attorneys or district attorney investigators in this state

Purpose

To establish the crime of making false statements within the jurisdiction of the judicial branch.

Summary of provisions

The penal law is amended by adding a new section 195.25 that establishes a Class E felony penalty for making false statements to a district attorney, assistant district attorney or district attorney investigator.

Justification

Current statutes contain no direct penalties for making false statements to district attorneys, assistant district attorneys or district attorney investigators during a criminal investigation, although federal laws carry penalties for making false statements to federal investigators.

Individuals involved in or who are witnesses to criminal activity, when faced with questioning, can always choose to invoke their right to counsel and refuse to answer questions. The act of offering deliberate misinformation or misleading information should carry penalties.
