Title of bill
An act to authorize the county of Clinton to reinstate and employ Aaron Heroux as a deputy sheriff
Purpose
Authorizes the county of Clinton to reinstate Aaron Heroux as a deputy sheriff, notwithstanding that such reinstatement will occur more than 1 year after leaving such position.
Summary of provisions
Section 1. Authorizes the county of Clinton to reinstate Aaron Heroux as a deputy sheriff with the sheriff's department of such county, notwithstanding the provisions of paragraph (b) of subdivision 4 of section 58 of the civil service law or any other provision of the law to the contrary, provided he provide a written request to that effect with the sheriff of the county of Clinton within one year of the effective date of this act.
Section 2. Establishes the effective date.
Justification
Aaron Heroux was a Clinton County Deputy Sheriff from March 2002 until February 2013, at which time he was forced to apply for disability retirement due to health problems related to Cystic Fibrosis. In February of 2014, Aaron received a bilateral lung transplant at Massachusetts General Hospital, and has since worked to beat all medical expectations and is now in full health and physical condition. Aaron's doctors from Massachusetts General Hospital have certified that he is capable of returning to work, and the Clinton County Sheriff has recommended him for the position. Aaron has been prevented from returning to work due to Section 58 of the New York State Civil Service Law, paragraph (a) age limit of 35 years. This bill would allow this dedicated civil servant to return to his position as Deputy Sheriff, provided he files a written request with the sheriff's department in Clinton county, and complies with the provisions of paragraph (c) of subdivision 1 of section 58 of the civil service law, which includes the height, weight and physical fitness requirements prescribed by the municipal police training council.
