Title of bill
An act to amend the public health law, in relation to school grade or age requirements for certain immunizations
Purpose
The purpose of this bill is to amend the grade or age requirements for the administration of a booster immunization containing diphtheria and tetanus toxoids, and an acellular pertussis (Tdap) vaccine.
Summary of provisions
Section 1 amends paragraph b of subdivision 2 of section 2164 of the Public Health Law to change the grade level at which those in a parental relationship must have their child receive a Tdap booster immunization from sixth grade to seventh grade.
Section 2 provides an immediate effective date, however, per section 1, the amended requirement will be imposed prior to the inception of the 2016-17 school year (September 1, 2016).
Justification
Section 2164 of the Public Health Law was amended in 2015 to require the administration of immunizing agents against meningococcal disease to children entering seventh grade, or a comparable age. The reason for the grade/age requirement for meningococcal immunizations is that it is consistent with the recommended immunization schedule promulgated by the Centers for Disease Control and Prevention (CDC). The same grade/age level is recommended for the Tdap booster immunization. This bill would make New York State law consistent with the CDC recommendations and required meningococcal immunization. Statutory consistency will facilitate compliance with parental obligations and record-keeping requirements for schools.
