Title of bill
An act to amend the education law, in relation to annual teacher and principal evaluations
Purpose
This bill will provide school districts with flexibility surrounding teacher and principal evaluations, while the Board of Regents transitions to a new system and ensures districts do not receive an aid penalty during this transition.
Summary of provisions
Section 1 provides for a moratorium on the implementation of the teacher and principal evaluation system contained within Education Law 32012-D until, at least, September 1, 2020. During this time a committee of experts will develop a new evaluation system.
Section 2 allows districts to locally determine the content of the evaluations during the transition to a new system. Districts also have the option of utilizing an evaluation system under Education Law 3012-C or 3012-D during this time. Additionally, a committee of experts will be charged with developing a new system and will report their recommendations to the State Education Department by September 1, 2020.
Section 3 requires districts to utilize the transition score developed under the appropriate evaluation plan to be used a significant factor in employment decisions.
Section 4 provides the effective date.
Justification
The Legislature developed a new teacher and principal evaluation system during the 2015 budget. As part of the new system, districts were required to have new plans in place by September 1, 2016 or risk losing their respective increase in state aid for that school year. Districts simply have not had enough time to appropriately collectively bargain the changes necessary to implement these new plans. Rather than rushing along a system and dealing with problems as they arise, this legislation seeks to put a pause on implementation and allow experts to develop a system with input from the various stakeholders. Many of the provisions of this legislation are consistent with practices already underway at the Board of Regents and taking this next step through legislation will give districts the reassurance they need that they do not need to collectively bargain a new plan, while another newer plan is in the works.
